Conflict Resolution Jhall Magsi

Jhall Magsi is basically a strong tribal centered area. Therefore, violent conflicts and tribal feuds occur frequently. To resolve these, both formal and informal methods are applied. Informal methods, like Jirga, arbitration and the Mairh are still more effective than formal methods, like civil and criminal cases. Jirga is usually held in serious cases like murder. Very influential persons like Sardars or spiritual leaders are involved in Jirgas. Their decisions are binding on both parties. Conflicting parties are allowed to be represented by a representative. Arbitration is usually done by the Mutbars of the different conflicting parties, assisted by some neutral members. Mairh is also very common, usually in case the conflict is not of a serious nature. Influential persons like Sardars, Mutbars or spiritual leaders are asked by one party to visit the house of the other party and to request them to forgive, which is usually excepted. The damaged party is compensated in accordance with the seriousness of the damage done. Compensation is paid in cash or property. In case of murder sometimes a girl is offered for marriage.

Criminal cases are first heard in the court of Naib-tehsildar, Tehsildar, SDM and then in the court of a Session Judge at Dera Allah Yar and Additional Session Judge at Usta Muhammad in Jaffarabad. Similarly, civil cases start proceedings at the Qazi court in Bhag (Bolan district). In case of appeal one may go to Majlis-e-Shora at Sibi.
